Fresh counter claim under Order VIII Rule 6A read
with Section 151 CPC for recovery of Rs.53,55,506.05/- has been
received by way of random allocation. It be checked and registered
as per rules.
Present: Sh. Lokesh, Ld. Counsel for plaintiff.
Heard. Perused.
Along with the said counter-claim, an application
under Section 149 read with Section 151 CPC (IA No.01/2026)
seeking permission to deposit the requisite court fee on next date
of hearing has also been filed.
Arguments on the said application heard.
Considering the facts and circumstances and in view
of the reasons mentioned in the application, the same is allowed
and the counter-claimant is directed to file the requisite court fees
before the next date of hearing. Accordingly application (IA
No.01/2026) stands disposed of.
It is brought to my notice by the Reader that
duplicate of the counter-claim has not been filed by the counter-
claimant.
Hence, counter-claimant is directed to do the
needful in this regard.
