Defendant in person.
Clerk of the counsel for defendant is present and has
intimated to this court that counsel for defendant is ill on account of
Covid and thus, an adjournment is being sought.
Ld. Counsel for plaintiff vehemently resisted/opposed
the plea submitting that the opportunity to file written statement on
behalf of defendant be closed.
Perusal of record shows that vide order dated 30.01.2025,
defendant was permitted to file written statement within 15 days.
Subsequently, again on 17.03.2025, another seven days were given to
defendant to file written statement subject to cost of Rs. 5000/-.
However, neither cost has been paid nor any written statement has been
filed till date. Clerk of counsel for defendant had intimated to the court
that counsel is ill for the past two months. However, defendant in the
present matter was served around six months back on 26.01.2025.
In these circumstances, considering the vehement
resistance on behalf of plaintiff, right to file written statement on behalf
of defendant stands closed.
Matter be listed for plaintiff’s evidence. List of the
witnesses be filed within 15 days with advance copy of same to other
party. Affidavit of examination of chief be filed within 15 days, copy of

same be supplied to other party at list 15 days prior to next date of
hearing. At request, copy of order be given dasti.
