As per the report of the process server, the non-
applicant/plaintiff was not found at the given address. It is further
stated in the report that upon inquiry a neighbour had given a
phone no. 9810493263 of the plaintiff on which the notice was
sent through WhatsApp. Accordingly, the plaintiff could not be
served at the given address. In so far as the notice through
WhatsApp is concerned, it is unclear whether the phone number
actually belonged to the plaintiff only. Ld. Counsel for the
appellant/defendant submits that he is not aware of any phone
number of the plaintiff.
Earlier, the plaintiff had filed execution proceedings
being Ex. No. 100/23 in respect of the subject decree dated
24.01.2023 passed in CS No. 640/2019 which proceedings were
ultimately transferred.
It would be appropriate to sent a notice to the ld.
Counsel for the plaintiff who had appeared in the execution
proceedings.
Issue notice to the plaintiff through the advocate Mr.
Sanjay Gupta on filing PF/RC/Speed-post. Plaintiff to take steps.
The defendant is additionally permitted to serve the plaintiff
through counsel by dasti mode.
Re-list for service report on 14.02.2024.

At this stage, Mr. Sanjay Gupta, Ld. Counsel for the
plaintiff/non-applicant has appeared and has sought sometime to
file reply. Let the same be filed within 4 weeks with advance
copy to the other side. He is apprised of today's order and the
next date of hearing. In as much as the plaintiff has now
appeared, there would be no requirement to issue any fresh
notice.
