The defendant has filed written statement, Statement
of Truth, list of documents alongwith documents and an
application seeking condonation of delay on 04.06.2025. The
defendant has also filed an affidavit of admission denial of
documents today.
The plaintiff has received the copies except the
affidavit of admission denial of documents. Let the same be
supplied to counsel of plaintiff.
The Counsel of defendant submits that there is some
typographical mistake in the application seeking condonation of
delay and he wants to withdraw the same with liberty to file it
afresh. Ld. Counsel of plaintiff submits that same is delaying
tactics but he has no objection.
The defendant may file the fresh application with
advance copy to Counsel of the plaintiff to which reply may be
filed by plaintiff. Plaintiff may also file the replication which will
be subject to written statement being taken on record. The case is
also fixed for First Case Management hearing and framing of
