Arguments heard on an application under Order VII Rule 1A (3) CPC filed on behalf of the defendant for placing on record some documents. Reply along with affidavit filed on behalf of the plaintiff to application u/o VIII Rule 1A (3) CPC filed by the defendant. Documents sought to be filed is on email communication dated 14.11.2025 exchanged between the plaintiff and the defendant and reason for non-filing of the same earlier is stated to be that it was not in the knowledge of the defendant at the time of filing of the WS and the other connected documents. Ld. Counsel for the Plaintiff has objected the application, however admitted that the documents sought to be filed is not as a consequence of a fact came up in the evidence of plaintiff. Considering that the documents are not related to be facts come up in the cross examination of the plaintiff and also considering the nature of the document, application is allowed subject to a cost of INR 5,000/- to be paid to the opposite party. Copy of the order also be sent to the Ld. Local Commissioner who shall fix date for the defendant evidence as per his convenience. Further report be awaited.
