Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 13 Execution (Comm.) 171/25 MANAVJIT SINGH SANDHU Vs. M/S PRATAP UNIVERSITY 23.04.2026 (At 10:44AM) Present : Sh. Mayank Maini, Ld. Counsel for the DH. Ms. Swati Surbhi, Ld. Counsel for the JDs through video conferencing. 1. One objection petition was filed on behalf of JDs, but it is not so mentioned that which JD has moved this application. It is supported by affidavit of Mr. Luvkush, who appeared before this court as AR of JDs. 2. A copy of order dated 08.04.2026, as passed by Hon’ble Delhi High Court in CM (M) 739/2026 has been also received. In that order, Hon’ble Delhi High Court had given liberty to the JDs to file objection within one week from that date but the objections are otherwise found to be filed only on 18.04.2026 physically before the court. Hon’ble Delhi High Court had kept it open for both parties to raise their contentions before this Court. Ld. counsel for DH seeks time to respond back to the objection. Reply, if any must be filed up to next date of hearing with advance copy to the opposite counsel. 3. Some other applications, filed on behalf of DH seeking order for breaking open the locks of the premises, which was not opened by a lady during visit of bailiff for execution of warrants of attachment. It is worth to note here that AR of JDs have not appeared nor any affidavit has been filed as per directions given to the JDs on the last date of hearing. HC had not stayed the operation of order passed on 18.03.2026 and it -- 1 of 2 -- only granted opportunity to file objections. Thus, JDs do not have this liberty to defy or ignore the directions given by this court. JDs are duty bound to furnish the details of assets in the form of affidavit, but same has been deliberately not filed by the JDs. 4. Issue warrants of arrest against JD No.3 on filing of PF and same be also sent to local SHO to execute it in accordance with law. Needless to say that for execution of this warrants, there might be necessity to locate this JD and to trace him as well. Any assistance may be taken from the DH. Steps for service be taken up within one week. DH to appear before ld. ACJ on 06.05.2026. DH to appear before this court on 28.05.2026. Pulastya Pramachala District Judge (Commercial Court)-01 Patiala House Court, New Delhi. 23.04.2026 At 12:35 PM. At this stage, I have noted that there was stay against warrants of arrest against JD no.3 in a different petition before Hon’ble Delhi High Court bearing no. CM (M) 475/2026. In view of the same, order regarding issuance of warrants of arrest is being recalled. Therefore, there is no need to appear before ld. ACJ. Put up the date fixed i.e. 28.05.2026. Pulastya Pramachala District Judge (Commercial Court)-01 Patiala House Court, New Delhi. 23.04.2026 -- 2 of 2 --
