Heard. File perused.
At the outset, Ld. Counsel of plaintiff states at Bar
that the plaintiff does not wish to file any written reply to the
application under Order I Rule 10 CPC moved by defendant no.
4 and he shall straight away advance arguments on the said
application.
Record shows that the defendant no. 4 was served on
29.11.2024, for 02.12.2024. However, the said defendant has not
filed any written statement either within the statutory period of
30 days therefrom or even within the maximum period of 120
days thereof.
Hence, the defence of defendant no. 4 is hereby
struck off.
It is jointly submitted that there is still an element of
settlement between the parties in this matter.

On joint request, put up on 19.05.2025 for
compromise/settlement, if any, or in alternative for arguments on
the injunction application.
