At 2:30 PM.
Present : Sh. Ajay Kumar Aggarwal, Ld. Spl. PP for the State.
Sh. Digvijay Singh Rana, Ld. Counsel for applicant/
accused.
ORDER
1. This is bail application u/s 483 of BNSS, 2023 for grant
of bail filed by applicant/accused Karan Rana, S/o Sh. Subhash
Rana.
2. Ld. Counsel for accused/applicant submitted that the
applicant/accused is a quite innocent person having no nexus with
the commission of alleged offence. He has been falsely implicated
by the local police in the present case. The accused has neither been
arrested on the spot nor from any place as alleged and lifted from
the house. The applicant has been introduced through online app i.e.
Telegram to a person for online investment scheme stating that he is
a banker and believing the same, the applicant and the co-accused

were lured by the person for opening accounts for the profit and
thereafter the person has taken the passbook ATM and sim card
from the applicant and the co-accused through Porter App. The
applicant has neither operated the accounts nor withdrawn the
amount as the same was being operated by some third person. The
accused is in custody since 16.06.2026. There is no likelihood of
tampering of the evidence and influencing the witness if the
applicant released on bail. The applicant has clean antecedents and
never been implicated or involved in any other criminal case prior to
the present one in which he is falsely implicated. There are no
possibilities of fleeing or absconding from the trial or due process of
law. The applicant undertakes to abide with the terms and
conditions, if imposed or directed by this Court. It is prayed for
grant the regular bail to the applicant.
3. Reply filed by the IO. Ld. PP for the State has opposed
the bail application on the basis of the reply filed by the IO. It is
submitted that the investigation of the present case is still at a very
initial stage and several important aspects of the case are yet to be
investigated. The bank account of the accused has been found
involved in cyber fraud transactions and cheated money has been
credited in Layer -1 of the account, which indicates the active
involvement of the accused in the crime. The accused may indulge
in similar offences again if released on bail, as the investigation has
revealed the use of multiple bank accounts for cyber fraud
transactions. There is also a possibility that the accused may

-3-
abscond and evade the process of law, if released on bail, thereby
hampering the investigation.
4. Arguments have been heard. Record has been perused.
5. Gist of the allegations are that during scrutiny of
complaints on the NCRP Portal, it was found that Bank account no.
00131000919775 of Punjab & Sind Bank was used for receiving
cyber fraud money. The said account is in the name of accused
Karan Rana. Two cyber fraud complaints were found linked with the
said account.
In the present case, during investigation, accused Karan
Rana and co-accused Sujal were arrested in the present case. During
interrogation, both disclosed that they had sold their bank accounts
to their associate/co-accused Chandan for receiving and transferring
cyber-fraud money. One day police custody remand was obtained,
and efforts were made to apprehend co-accused Chandan; however,
he could not be traced.
Investigation has revealed that in Complaint No.
30805260041424, an amount of Rs. 17,530/- was credited in
Layer-1 in the bank account of accused/applicant Karan Rana, while
in Complaint No. 22905260051275, an amount of Rs. 50,000/- was
credited in Layer-2 in the same account. Thus, the role of the
accused is reflected in the flow of cheated money.
6. Further investigation revealed another bank account of
accused/applicant Karan Rana with Canara Bank, which, on
examination of the account statement, was also found to have been
used as a mule account for receiving and transferring cheated

-4-
money. Investigation in respect of the said account is still pending.
The co-accused Chandan is yet to be apprehended.
7. The seriousness of the allegations, the prima facie
material collected against the applicant, the alleged commission-
based supply of mule bank accounts and the requirement of further
investigation are relevant considerations while deciding the present
application.
8. The fact that the applicant has no previous criminal
antecedents and has been in custody since 17.06.2026, though
relevant, by itself does not outweigh the nature of the allegations
and the stage of investigation in the present case.
9. At the stage of bail, this Court is not required to
conduct a detailed appreciation of evidence. The material available
on record, when considered in its entirety, raises prima facie
circumstances connecting the applicant with the alleged offence.
The defence of the applicant shall be considered appropriately at the
stage of trial.
10. In view of the gravity of the allegations, the prima facie
material available on record, the alleged active role of the applicant
and the fact that the investigation is still underway, this Court is not
inclined to exercise the discretion in favour of the applicant at this
stage.
Accordingly, the present bail application filed by
applicant/accused Karan Rana, S/o Sh. Subhash Rana is dismissed.
Nothing stated herein shall be construed as an expression of
opinion on the merits of the case. The observations made above are
-- 4 of 5 --

prima facie and confined solely to the adjudication of the present
bail application.
TCR be sent back to the Court concerned.
Bail application stands disposed of accordingly.
Copy of order be given dasti as prayed for.
