This is a criminal appeal under Section 415(3) of BNSS challenging the judgment of conviction dated 09.04.2026 as well as order on the point of sentence dated 28.07.2026 passed by the court of Ld. JMFC, NI- Act, PHC, New Delhi. The appeal is accompanied with an application under Section 430(1) of BNSS seeking suspension of sentence dated 28.07.2026 passed by the trial court. Submissions heard. Application under Section 430(1) of BNSS seeking suspension of sentence is allowed. Operation of order on sentence dated 28.07.2026 passed by the trial court is stayed till final disposal of the appeal subject to deposit of 20% of the fine/compensation amount awarded by the trial court within 60 days and furnishing of fresh personal bond for a sum of Rs.20,000/- with one such surety of the like amount. Applicant/convict is directed to furnish bail bonds in the sum of Rs.25,000/- with one surety of like amount before the Trial Court. Issue notice of the appeal to the respondent on filing of PF/RC as well as approved courier returnable on 28.01.2027. TCR be summoned for next date of hearing. List on 28.01.2027.
