PP for State with IO. Sh. J. K. Sharma, Ld. Counsel for applicant/accused. Present is an application moved on behalf of applicant/accused Rupinder @ Nanha for grant of bail. It is submitted that applicant/accused has been falsely implicated in the present case as nothing incriminating has been recovered from the possession of applicant/accused and he has nothing to do with the alleged offence. It is submitted that recovery has been planted upon him as nothing incriminating has been recovered from the possession of applicant/accused. It is submitted that chargesheet has been filed in the instant matter and no fruitful purpose would be served by keeping him behind the bars as trial in the instant matter is likely to consume considerable time. It is thus prayed that he may be released on bail. Ld. Addl. PP has vehemently opposed the bail application arguing that applicant/accused is a desperate criminal who is previously involved in more than six cases of murder and other heinous offences and a reward of Rs.2.0 lacs has been declared upon the applicant/accused by the Haryana Police. It is submitted that in order to resist his arrest, applicant/accused alongwith his associate Amit Suthar fired upon the police party. It is submitted that two sophisticated semi automatic pistols alongwith six live cartridges were recovered from the possession of both accused persons and one country made pistol with two live cartridges were recovered from the glove box of Honda City Car which was also taken into possession. It is submitted that the said Honda City Car was also found to be stolen on which fake number plate was placed by the accused persons. -- 1 of 2 -- Applicant/accused is a habitual offender reported to be involved in six cases of murder and attempt to murder and other heinous offence. In the instant matter, applicant/accused has not only resisted his apprehension but he has also the audacity to fire gunshots upon the police officials. Considering the seriousness of allegations, enormity of charge and the past criminal antecedents of the applicant/accused, I am not inclined to release the applicant/accused Rupinder @ Nanha on bail. His bail application accordingly stands rejected. Application is disposed off accordingly. (Dharmender Rana) ASJ02, NDD/PHC/New Delhi 30.11.2021 -- 2 of 2 --
