Mr. Rupesh Kumar, Ld. Counsel for defendant no. 6
along with defendant no. 6.
Ld. Counsel for the plaintiff submits that
inadvertently the PF could not be filed and has requested for
another opportunity for publication. Let the publication be made
in terms of the previous order dated 10.04.2023.
Ld. Counsel for the plaintiff has submitted that the
present suit is a suit for partition and that the parties may be
directed to maintain status quo as to the possession and title of
the suit property during the pendency of the suit.
Ld. Counsel for the defendant no. 6 submits that
even as per the allotment slip/patta of the subject property, the
property cannot be sold/transferred to any third party. It is further
submitted on instructions that the defendant no. 6 undertakes to
not create any third party rights in the suit property with respect
to possession during the pendency of the present suit. Separate
statement of defendant no. 6 is recorded to this effect.
In view of the aforesaid submission, the parties are
directed to maintain status quo with respect to the title and
possession of the suit property. Application under Order 39
Rule 1 and 2 CPC is disposed of accordingly.
