Fresh criminal revision is received by way of
assignment. It be checked and registered as per rules.
Present: Sh. Anish Dhingra, Ld. Counsel for both the
petitioners.
Heard. Revision file is carefully perused.
In the present revision petition, the petitioners have
assailed order dated 31.08.2024 of Ld. Judge, Evening Court-02,
NDD, PHC, New Delhi whereby cognizance for the offence
punishable under Section 24 of The Contract Labour Act, 1970
was taken and they were summoned as accused for facing trial
for the said offence.
Notice of this revision petition be issued to the
respondent upon filing of PF/RF as well as through approved
courier returnable on 10.12.2024.
Ld. Counsel for the petitioners submits that the
impugned order has been passed in violation of the provisions
contained in Section 223 BNSS as they were not heard before
taking cognizance for the said offence.
In the given facts and circumstances, proceedings
before the Ld. Trial Court shall remain stayed till next date of
hearing.
As prayed, copy of this order be given
dasti.
