Matter is at the stage of consideration on the point of
limitation. Today, copies of the relevant document and record
pertaining to the filing of present appeal has been filed.
Ld. Counsel for the appellant submits that the
present appeal was initially placed before the Ld. Sessions Court
due to the mistake of the Registry. It i further submitted that
thereafter, the matter was again placed before this Court by the
Registry; however before such placement, the appeal was
retrieved by the filing section on 31.07.2026. The aforesaid
circumstances, are stated to have a bearing on the computation of
period of limitation.
In view thereof, before proceeding further on the
question of limitation a report be called from the Incharge, Filing
Section, PHC, New Delhi, specifically indicating the dates and
relevant particulars regarding initial filing of appeal, its
placement before Ld. ASJ Court, its retrieval and subsequent
placement.
