Present : Advocate Apoorva Behl, counsel for the plaintiff.
Heard.
The present suit under Order XXXVII CPC is filed for
recovery of specified amount arising out of invoices. Non-starter
report of pre-institution mediation, statement of truth and list of
documents are already on record. Prima facie from the averments of
the plaintiff, it appears to be a commercial dispute.
Issue summons for appearance to the defendant
through all modes i.e. RC/Speed Post/Courier/E-mail/Whatsapp and
FAX etc on filing of PF and soft copy of complete paper book of
the suit in PDF format through email or in a device. For service
through electronic mode, plaintiff to file affidavit with respect to the
correctness of the address and contact details.
It be specifically mentioned on the summons that as
per Order XXXVII defendant is required to file its memo of
appearance within 10 days from the date of service.
