Present: Sh. Arvind Bhardwaj, Advocate for the petitioners along
with petitioners in person.
None for R-1 and R-2.
Ms. Vandana Kahlon, Advocate for R-3/Insurance
Company.
Case is listed today for pre-Lok Adalat sitting.
Ld. Counsel for Insurance Company has offered an amount
of Rs. 19,24,384/- to the petitioners, however, the said amount is not
acceptable to the petitioners present in the Court. They submit that the
deceased besides doing job in M/s R.L. Gupta & Sons was also
working as a part time accountant in a private firm where he was
drawing additional income of Rs. 10,000/- per month.
It is thus submitted that the issues be framed in the present
matter. After going through the pleadings and hearing Ld. Counsels for
parties, the following issues are framed as :-
1. Whether the deceased Nilesh Kumar sustained fatal
injuries in the accident which occurred on 26.06.2020 at
11.30 pm, infront of Ber Sarai Flyover, near MCD Dustbin
on Ring Road leading from Munrika to Hauz Khas, New
Delhi caused by rash and negligent driving of vehicle No.
DL-1GC-7200 being driven by respondent no. 1, owned by
respondent no.2 and insured with respondent no. 3 ?
OPP.
2. Whether the petitioners are entitled for compensation?
If so, to what amount and from whom?
3.Relief.
No other issue arises or is pressed for.

Now, put up for consideration on the aspect of appointment
of Local Commissioner for recording of evidence as well as for
compliance of previous directions regarding opening of bank account
etc. on 03.09.2022. Let petitioners file their complete evidence along
with documents, if any, on or before the next date of hearing.
