Vague report filed by the IO, response to the bail
applications, are accompanied by his request for exemption.
There is no reference, whatsoever to any investigation
carried out by him, as also, specific role attributable to the
applicants/accused, who are 5 in number in the present case.
Whether these applicants were residing with the
complainant and the main accused or separately and for how long is not
mentioned in the replies. Specific role attributable to each of the accused
is not mentioned.
Considering the vague reply filed by the IO, notice be
issued to the IO to appear in person in court.
I have been informed that bail application of the husband
has already been disposed off and even the said fact is not mentioned in
the reply. Therefore, it seems that the SHO has acted in a very casual

manner forwarded the replies to this court. The contents of the replies
show that the Investigation Agency has failed to apply its mind to the
guidelines laid down in Arnesh Kumar’s case and relevant aspects are
not being taken into consideration.
Therefore, SHO is also directed to appear in person
alongwith IO.
