Matter taken up through hybrid hearing pursuant to directions issued by
Hon'ble High Court of Delhi vide order No. 798/RG/DHC/2021 dated
29.10.2021.
Present: Sh. S.K. Kain, Ld. Addl. PP for the State through VC.
Sh. R.K. Wadhwa and Sh. Rajesh Aggarwal counsels for
applicant/accused through VC.
IO SI Manish is present through VC.
The present case is hanging on a weak thread inasmuch as the
present accused is concerned and the only advantage is that the money was
never withdrawn and therefore, the present case is one of attempt to cheat but
the aspect of forgery would have to be seen by the IO.
Considering that two coaccused persons directly involved in
the offence have already been granted bail by the court of Sh. Praveen Singh,
Ld. ASJ, PHC, New Delhi, the present accused cannot be treated any differ
ently.
Accordingly, accused is admitted to bail on furnishing of bail
bonds/surety bonds in the sum of Rs.1,00,000/ (Rupees One Lac Only) with
one surety of like amount to the satisfaction of concerned Ld. MM/Duty MM
subject t the condition that he shall not approach any witness or tamper with
any evidence.
Application disposed off.
