This is the application for regular bail filed on behalf of
applicant/accused Shoaib.
Present: Sh. Ghanshyam, Ld. Addl. PP for the State.
Sh. Deepak Tyagi & Sh. Hitesh Kumar, ld. Defence
Counsel for accused.
IO/ ASI Parveen Yadav is present.
As per report of the IO, on the basis of the opinion
obtained from the prosecution branch, since, the time of offence
is prior to 01.07.2024 i.e. on 13.03.2024, the sections have been
changed to 379/411/34 IPC.
The allegations against the applicant are that he had stolen
the bike of the complainant. The applicant is in custody since
16.08.2024.
Considering the nature of allegations, that applicant is in
JC since 16.08.2024, let the applicant / accused Shoaib be

released on bail subject to furnishing PB/SB in the sum of
Rs.10,000/- to the satisfaction of Ld. MM/Link MM/Duty MM
and further subject to following conditions :
1. The applicant shall intimate the Court by way of an
affidavit and to the Investigating Office regarding any
change in residential address.
2. The applicant shall appear as and when the matter is taken
up for hearing.
3. The applicant is directed to give his mobile number to the
Investigating Officer and keep it operational at all times.
4. The applicant shall not, directly or indirectly, tamper with
evidence or try to influence the witnesses in any manner.
Nothing stated herein above shall tantamount as an
expression of opinion on the merits of the case. The copy of the
order be given dasti to the ld. counsel for accused / applicant and
one copy of the order be sent to concerned Jail Superintendent.
Application is disposed off accordingly.
