Andrew Mwaura 22.09.2022 Present: Sh P C Aggarwal, Ld. SPP for NCB along with IO Sachin Kumar. Accused produced from JC. Medical documents of accused filed by the IO. Same be taken on record. Accused was offered for the appointment of lawyer at State expenses but accused declined the same by submitting that he has engaged a private counsel. This complaint has been filed by a public servant Sh. Sachin Kumar, IO in discharge of his duties. He has moved an application for dispensing with his preliminary examination and for his exemption from personal appearance for future dates on the ground that he remains busy in official duties and it is not possible for him to attend the court on each and every date of hearing and that he be therefore allowed to be represented through the Special PP. In view of the submissions made, the preliminary examination of the complainant is dispensed with and he is exempted from personal appearance during trial. Perused the complaint. It has been alleged in the complaint that on 05.03.2022, on the basis of information, accused was intercepted at IGI airport, New Delhi and she was admitted in the hospital for further medical assistance for easing out the drug filled capsules. During her stay in the hospital, she had eased out 100 capsules and 1.090kg cocaine was recovered from those 100 capsules. It is also the case of the prosecution that accused is indulged in the -- 1 of 2 -- 2 illegal possession and import of the recovered cocaine in commercial quantity. In the considered opinion of this Court, the material on record is sufficient to take cognizance of the offences punishable U/s 21 (c) & 23 (c) of NDPS Act.
