This is an application u/s 438 Cr.PC seeking pre-arrest bail
of accused/applicant Anil Kumar. It is matter of record that
earlier accused/applicant was served with notice u/s 41A Cr.PC
and thereafter he was bound down by previous IO.
Without going into the merits of the matter, although ld.
Counsel for accused/applicant submitted that main accused in the
matter has already been granted bail vide order dated 03.01.2023.
This court need not to go into merits of the matter when IO Insp.
Babu Lal of DIU has submitted in the court that once accused/
applicant has already been bound down after service of notice u/s
41A Cr.PC, there is no intention on the part of the IO to arrest the
accused/applicant and notice was served to him only to secure
presence of the accused/applicant at the time of filing of charge
sheet.
In view of above said reasons application is rendered
infructuous and not pressed for. Accordingly application stands
disposed off being not pressed for.
