Ld. Counsels for both the petitioners along with
petitioner no.2.
Heard. Revision file is carefully perused.
In this revision petition, the petitioner has assailed
order dated 30.08.2024 of Ld. JMFC-01, NDD, PHC, New Delhi
in a criminal complaint case under Sections 138/141 NI Act
instituted by the respondent against the petitioners whereby their
application dated 29.08.2024 for seeking dismissal of the said
complaint on the ground of lack of territorial jurisdiction was
dismissed with a cost Rs.3,000/- and their right to lead defence
evidence was closed.
Ld. Counsel for the petitioners submits that he
intends to withdraw the challenge for dismissal of the said
application and the present revision petition may only be treated
as a revision petition for setting aside of part of the impugned
order dated 30.08.2024 whereby his DE was closed. The said
request is allowed and this revision petition be only considered to
be challenge against closure of DE vide impugned order dated
30.08.2024.

The petitioners are directed to deposit cost in
accordance with order dated 30.08.2024.
Issue notice of this revision petition to the
respondent as well as its counsel, upon filing of PF/RC and on
deposition of receipt of the said cost, returnable on 05.09.2024.
TCR be summoned for the said date.
