Today matter is fixed for admission-denial of the
documents and prosecution evidence.
Ld. Counsel for accused Tajeem submits that
accused want to admit document u/s 294 Cr.P.C. Separate
statement of accused is recorded to this effect.
In view of the above statement, accused Tajeem
submits that he has no objection, if the examination of witness
mentioned at serial no.5 of the list of witnesses is dispensed with.
Ld. Addl. PP for State also intends to drop the said witness.
In view of the same, said witness stands dropped
from the list of witnesses. Ahlmad is directed to make
necessary endorsement in the list of witnesses.
Summons issued to PW SI Priyavart received back
served.
A written request received on behaf of the PW SI
Priyavart on the ground that he has gone out of station vide DD

no.90A dated 22.02.2024 for investigation purpose in case FIR
no.46/2024, PS Special Cell and unable to appear in Court.
Heard. Allowed.
PW SI Priyavart be summoned again for next
date of hearing.
PW1 Sh. Kaif, PW2 Sh. Salman & PW3 Sh. Tanveer
are examined-in-chief, cross-examined and discharged.
Issue summons to the witnesses i.e. M.M. Lodi,
Nodal Officer Jio, Nodal Officer Airtel and HC Pawan
Kaushal for next date of hearing.
List for PE on 08.04.2024.
It is submitted by the Ld. Counsel for the accused
Irshad that application dated 30.01.2024 becomes infructuous as
prayer of the application to summon the witnesses mentioned at
serial no.2 to 4 has already been examined.
In view of the submissions, aforesaid application
stands dismissed as infructuous.
An application under Section 439 Cr.P.C. for
granting bail filed on behalf of the accused Irshad and another
application under Section 439 Cr.P.C. for grant of bail filed on
behalf of the accused Tajeem.
Issue notice to the IO to file reply to the abovesaid
applications.
List for reply and arguments on the bail applications
of the accused persons on 21.03.2024.
