Sh. Mohammad Yasir, Ld. Proxy counsel for
applicant.
Assistant Jail Superintendent Parvesh Kaushik is
present in pursuance of order dated 13.10.2025. He has filed the
written explanation in compliance of the said order. Same is
taken on record. The concerned Jail Superintendent is directed to
be more careful in future and to ensure that the directions passed
are complied in a time bound manner.
As per the report filed by the concerned Jail
Superintendent, accused Mohammad Mustakeem had duly
surrendered on 17.05.2023 and the intimation was duly sent to
this Court on 18.05.2023.
The concerned Jail Superintendent is discharged.
In view of the report filed today, the present
application stands allowed. The bail bonds/surety bond furnished
by him on behalf of accused stands discharged. Let the original
FDR be released to the applicant, as per rules. The NCB is
directed to ensure that the IO inform the concerned bank that the
FDR has no lien attached to it and same may be released to the
applicant. The concerned Bank Manager, Union Bank of India
shall allow the applicant to encash the FD amount, if the
applicant so chooses.
The application stands disposed of accordingly.
