Counsel for applicant/accused Ganesh Hegde.
Reply has been filed on behalf of State. Copy supplied.
Submissions have been heard in part.
During the course of submissions, it is submitted on
behalf of accused that they are ready to transfer the amount, allegedly
received in the bank account of applicant/accused, to complainant/
victim. Copy of voucher transferring Rs.11 lakhs in the bank account
of complainant/victim is placed on record.
Complainant/victim is present in court and confirmed
receipt of said amount of Rs. Eleven Lakhs.
Accused is stated to be under arrest/custody since
09.08.2024. In the report filed by the State, no previous involvement
of accused is reported. Accused is now stated to be in JC which
implies that his further custodial interrogaton is not required.
Therefore, in view of the above discussion,
applicant/accused is admitted in bail on furnishing the bail bond of Rs.
50,000/- with one surety of equivalent amount to the satisfaction of
Ld. Trial Court/Duty MM and subject to condition that :

i. Applicant/accused shall appear before IO whenever he is so
called by the IO and cooperate in the investigation;
ii. The applicant/accused shall not tamper with evidence nor
contact the witness;
iii. Applicant/accused shall not leave the country without
permission of Ld. Trial Court and in that regard, concerned
authority be informed who shall take appropriate action.
Application stands disposed of accordingly. Copy of
order be given dasti, as requested.
