along with plaintiffs in person.
Mr. Vishwendra Verma, Ld. Counsel for the
defendant through VC.
Ld. Counsel for the defendant requests for an
adjournment on the ground that he needs instructions from the
defendant.
Request for adjournment is opposed.
It is submitted by Ld. Counsel for the plaintiffs that
the right of the defendant to file written statement has already
been closed. He submits that the defendant is only trying to delay
the disposal of the case.
Record is perused.
It was way back on 27.07.2023 that the right of the
defendant to file written statement was closed.
Matter is at the stage of recording plaintiffs’
evidence.
Ld. Counsel for the defendant is required to only
cross-examine them. It has not been clarified as to what
instructions the Ld. Counsel for the defendant needs from the
defendant for cross-examination of the plaintiffs, which could not
have been taken till now.
Request for adjournment is declined.
Plaintiffs have tendered their evidence by way of

affidavit. They are not cross examined despite opportunity. The
right of the defendant to cross-examine the plaintiffs is hereby
closed.
Ld. Counsel for the plaintiff submits that the
plaintiffs wishes to examine one more witness.
At his request, matter is adjourned for plaintiff’s
evidence to 17.12.2024.
