SHWETA CHAUHAN Vs. Reliance Communications Limited
08.09.2026
Present : Sh. Hari Krishan, Ld. Counsel for the plaintiff.
Sh. Aditya Swarup (through VC) and Ms. Kriti Gupta,
Ld. Counsels for the defendant.
The plaintiff has moved an application for initiation of
contempt proceedings against the defendant/respondent contending
that as per terms of settlement para no. 5.3 the defendants were
required to carry out water proofing exercise at the roof of the
plaintiff and also remove debris.
It is submitted that the defendants/respondents have
breached the said voluntary undertaking and thus contempt
proceedings ought to be initiated against the defendants/respondent.
After a brief demur, counsel for the respondents submits that the
respondents are ready and willing to discharge their obligation
under the terms of settlement but the plaintiff is not cooperating in
the entire exercise. It is submitted that the plaintiff is not permitting
access to the defendant to get the water proofing done.
Counsel for the plaintiff/applicant strongly refutes the
contention and submits that the plaintiff shall be rendering all
possible assistance to the defendants. He further submits that he
shall ensure due cooperation of his client in this regard.
I have absolutely no reasons to doubt the solemn
assurance to this Court by a responsible officer of the Court.
In view of the above, the respondent is directed to
inspect the roof in question immediately and shall ensure the
removal of the debris within 2 days from today and shall ensure the

completion of the entire water proofing exercise by 15.10.2026. The
entire proceedings shall be photographed and videographed at the
expenses to be borne by the plaintiff herein, in case if the plaintiff
fails to provide for videography, the defendant shall arrange a
photographer of his own and the amount spent in arranging the
photographer shall be duly recovered from the plaintiff / adjusted
against the cost of water proofing.
Accordingly, at request, list the matter for compliance
report/further proceedings in the matter on 15.10.2026.
At this juncture, counsel for the respondent submits
that all his contentions may be taken on record without prejudice to
his rights to agitate the issue of jurisdiction of this Court to entertain
the present application.
