Present: Sh. Ankit Dang (appearing through V/C), ld. counsel
for plaintiff.
As per report received, defendants were served
through WhatsApp on three (3) given numbers on 26.09.2025.
Complete plaint was also sent to the defendants through
WhatsApp and these WhatsApp numbers are stated to be as
provided by defendants. Accordingly, defendants are deemed to
be served on 26.09.2025. Till date no WS has been filed on
behalf of defendant.
There is no application for extension of time. The
stipulated time period of 30 days from date of service has already
lapsed and there is no reason for this court to presume any reason
for the defendants to extend the time limit as provided under VIII
Rule 1 CPC. Hence, opportunity to file Written Statement is
closed. Accordingly, matter is now fixed for evidence of plaintiff.
On next date, AR of plaintiff shall appear along with
all the original relied upon documents, if not so filed, and
affidavit. Put up on 17.02.2026, for plaintiff’s evidence.
