Notice of the present revision petition be issued to
opposite party on filing of PF.
The impugned order of Ld. Trial Court dated
13.07.2023 is perused. It is observed by the Ld. Trial Court:
“That the ratio laid down in the case of Gimpex Private Limited
Vs. Manoj Goel, squarely applies to the facts of the present case
therefore, the Ld. Trial Court cannot review its own order of
summoning in view of the decision of Adalat Prasad therefore,
request is made by the Ld. Counsel for revisionist to stay the
proceedings before Ld. Magistrate till the next date of hearing.
It is further submitted by Ld. Counsel for revisionist
that in order dated 13.07.2023, the complaint case no. 35909/16
has been wrongly mentioned, as the original/ earlier complaint
case number is 39733/16.
Heard. File perused.
The proceedings before Ld. Metropolitan
Magistrate-04 (NI Act), Rouse Avenue Court Complex are stayed
till NDOH.
Put up for appearance/ arguments on 27.08.2023.
TCR be also summoned.
