Counsel for the petitioner that vide order dated 29.05.2025 the petitioner was directed to place on record Arbitral Record and original documents in view of para 58 of the Award dated 01.06.2024 passed by Ld. Arbitrator which indicated that all papers forwarded to the Arbitrator were handed over to the claimant/petitioner herein. It is stated that initially arbitration was conducted before Ld. Arbitrator – Hon’ble Mr. Justice R.C.Chopra and thereafter before Hon’ble Mr. Justice Sanjib Banerjee. It is stated by ld. Counsel for petitioner that original record which was available with Hon’ble Mr. Justice R.C.Chopra was not handed over to the successor Arbitrator - Hon’ble Mr. Justice Sanjib Banerjee by DIAC / Hon’ble Mr. Justice R.C.Chopra and therefore the arbitral record was reconstructed at that stage and the claimant/respondent had handed -- 1 of 2 -- over copies of their respective pleadings to Hon’ble Mr. Justice Sanjib Banerjee. It is stated that therefore the petitioner does not have the entire original arbitral record and he has the record which was handed over to him by Ld. Arbitrator – Hon’ble Mr. Justice Sanjib Banerjee. Ld. Counsel for the respondent does not oppose the submissions made by ld. Counsel for petitioner and he submits that he shall have to take instructions from the concerned department. In these circumstances, renotify the matter for submission of arbitral record on 13.03.2026. Today ld. Counsel for respondent is present through VC and he is directed to appear in person alongwith concerned official on the next date of hearing for verification of the arbitral record.
