None for defendant.
As per the record, the prayer for recovery of possession
of property i.e. DDA Flat No. 4029, Third Floor, Sector B, Pocket 5
& 6, Vasant Kunj, New Delhi has already been allowed and decreed
in favour of plaintiff by my Ld. Predecessor vide order dated
04.10.2025.
Ld. Counsel for plaintiff submits that in view of the fact
that plaintiff has received the decree of possession, no prayer made
in application under Order XXXIX Rule 1 & 2 CPC survives.
In these circumstances, the said application is
dismissed being infructuous.
From the pleadings of the parties, following issues are
framed with respect to remaining prayers in the plaint.
(a) Whether the plaintiff is entitled to recovery
of sum of Rs. 61,600/- as arrears of rent as
prayed for? OPP.
(b) Whether the plaintiff is entitled for mesne
profits, and if yes, for what period and at what
rate? OPP.
(c) Whether the suit has not been propery
valued for the purpose of court fees? OPD.
(d) Relief.
No other issue arises or pressed for.

Matter be listed for PE on 17.02.2026.
Affidavit in evidence be filed by the plaintiff on or
before the next date of hearing after supplying the copy to the
opposite party at least 10 days prior to the next date of hearing.
