Let summons be issued to the defendant on filing of
PF/RC and speed post. Plaintiff to take steps.
Relist for service report on 28.10.2024.
Ld. Counsel for the plaintiffs has submitted that the
plaintiffs are the owners of the suit property being DDA Flat
No.4029, Third Floor, Sector B, Pocket 5 and 6, Vasant Kunj, New
Delhi and that the defendant was inducted therein as the tenant and
the tenancy already stands terminated.
Ld. Counsel has submitted that till the NDOH, the
defendant may be restrained from creating any third party rights in
the suit property, otherwise, the plaintiffs shall suffer irreparable
loss.
Till the next date of hearing, the defendant is
restrained from creating any third party rights in the suit property.
Plaintiff to comply with provisions of Order 39 Rule 3
CPC.
