Fresh criminal appeal u/s 374 CrPC received. It be checked
and registered.
Present: Appellant in person with Sh. Kedar Yadav, Sh. Rahul Yadav and
Ms. Abha Singh, Advocates.
Heard and perused the record.
Vide judgment dated 27.04.2022, the appellant has been convicted
for the offence punishable u/s 279 IPC and vide order on sentence dated
29.06.2022, the appellant has been sentenced to pay a fine of Rs.30,000/, out of
which Rs.20,000/ will be paid as compensation to the complainant and
Rs.10,000/ will be paid to the State and in default, the appellant shall be liable to
undergo simple imprisonment for one month.
Along with the appeal, the appellant has also moved an application
u/s 389 CrPC for suspension of the sentence.
In view of the submissions of the Ld. Counsel for the appellant, the
sentence dated 29.06.2022 is suspended till disposal of the present appeal, subject
to furnishing of personal bond in the sum of Rs.10,000/ with a surety in the like
amount to the satisfaction of the Ld. Trial Court.
Issue notice of the appeal to the State for the next date of hearing.
To come up for arguments on 13.10.2022. TCR be called for the
next date. Copy of the order be sent to the Ld. Trial Court.
