This is second bail application moved on behalf of
applicant Shivam Bhadoria @ Chotu @ Tushar.

Ld. Sr. Counsel submits that the prosecution has made a
specific statement before the Hon’ble Delhi High Court and the same
is recorded in order dated 27.02.2026 that Ld. Addl. Public Prosecutor
submitted that a material report of the Forensic Science Laboratory
(FSL) is expected today in respect of the bullet recovered from the
body of the victim, the cartridge recovered from the site of occurrence
and the pistol allegedly recovered from the applicant and the next date
of hearing before the Sessions Court is 27.03.2026 by which time the
prosecution expects to file the supplementary charge-sheet alongwith
the FSL report. It is also submitted that in the light of the same, the
application was not pressed with liberty to life a fresh application

before this court after filing of the supplementary charge-sheet and the
application was disposed off by the Hon’ble High Court. It is also
submitted that the present application is pending adjudication since
29.05.2026 and till date no supplementary charge-sheet with FSL is
filed by the IO/prosecution which is in cross violation of the statement
made before the Hon’ble High Court by Ld. Addl. PP.
SHO/ Insp. Gurmail Singh submits that on instructions
of IO namely SI Santosh, who is on medical rest, as per letter dated
21.02.2026 received from Director FSL Delhi addressed to Hon’ble
ASJ-4, PHC, New Delhi, it was mentioned that in this connection it is
submitted that the case No. SFSL/DLH/11506/Bail/967/25 and SFSL/
DLH/13921/Bail/ 1112/25 have been taken on priority and the FSL
report of both the reports shall be ready by 27.02.2026, and the same
is not received till date. Separate statement of the SHO recorded to
this effect.
At this stage, Ld. Sr. Counsel submits that the
application may be disposed off as dismissed as withdrawn in view of
the above. Separate statement of Ms. Shivani, Ld. Counsel is recorded
to this effect.
In view thereof, present application is disposed off as
dismissed as withdrawn.
