Complainant Sandeep Tomar through VC (correctly
identified by the IO).
This is the bail application filed on behalf of
accused Kuldeep.
It is submitted by the Ld. Defence Counsel that the
applicant has been falsely implicated in the present case. He is a
young boy and is the sole bread earner of his family. He has no
previous involvement. The investigation qua him is already
complete. The applicant is in custody since 24.06.2025. It is
further submitted that as per the report of the IO the cheated
amount was transferred into different account. It is submitted that
applicant is infact the victim in the present case, however,
without prejudice to his rights and contentions during trial, he is
ready to pay Rs.50,000/- to the complainant. It is prayed that the

applicant be released on bail. He is ready to abide by any
condition imposed by the court.
As per report of the IO, Rs.4,95,000/- was transferred in
the account of Seta Sahil Sabirbhai. The said account was
accessed multiple times on different dates by the Internet of CAF
registered in the name of applicant / accused Kuldeep. Even the
handset in which the registered number SIM was used was
recovered from the possession of the applicant.
At this stage, it is submitted by the complainant that he is
ready to accept the amount of Rs.50,000/- without prejudice to
his rights and contentions during trial.
Perused the report of the IO. As per report of the IO, the
cheated amount has been received in some other account.
Considering the nature of allegations; that the applicant is in JC
since 24.06.2025; he has no previous involvement; the
investigation qua him is complete; he has paid the amount of
Rs.50,000/- to the complainant without prejudice to his rights and
contentions during trial, let he be released on bail, subject to
furnishing PB/SB in the sum of Rs.20,000/- to the satisfaction of

ld. JMFC/Link JMFC/Duty JMFC and further subject to
following conditions :
1. The applicant shall intimate the Court by way of an
affidavit and to the Investigating Office regarding any
change in residential address.
2. The applicant shall appear as and when the matter is taken
up for hearing.
3. The applicant is directed to give his mobile number to the
Investigating Officer.
4. The applicant shall not, directly or indirectly, tamper with
evidence or try to influence the witnesses in any manner.
Nothing stated herein above shall tantamount as an
expression of opinion on the merits of the case. The copy of the
order be given dasti to the ld. counsel for accused / applicant and
one copy of the order be sent to concerned Jail Superintendent to
be served upon the accused / applicant.
Application is disposed of accordingly.
