Order Details: COPY OF ORDER
Pdf Text: Bail Application no.1891/21 and 1892/21
FIR no.103/17
PS Parliament Street
Under Section: 420/406/467/468/471/120B IPC
Rakesh Sehgal Vs. State & Ors.
27.04.2022
Present: Sh.Ashok Kumar, Ld. Addl. PP for the State.
Sh. S. K. Sharma, Ld.counsel for the non applicant/accused.
Sh.Sudarshan Ranjan and Sh. Hitain Bajaj, Ld.counsel for the
applicant/complainant with complainant in person.
Sh. Dinesh Kumar, ACP Parliament Street on behalf of DCP,
New Delhi District.
IO/SI Raj Kiran in person.
A report is filed under the signatures of Joint Commissioner
of Police, New Delhi District. It is stated in the report that the enquiry into
this matter has been marked to ACP/PG Cell New Delhi District. It is
further stated that as inquiry will take some time, it is requested to give
four weeks time to complete the inquiry and submit the report.
On 12.04.2022, Ld. Roster Judge/ASJ-02, New Delhi District
has observed as under:
“In the case at hand, neither any reason is discernible in the
reply filed by Adll. DCP nor any palpable reason is brought

concerned IO are available not only to the court but even the complainant,
who though an important stakeholder in a criminal trial, at times
unfortunately, remains neglected.
The objective of the court to direct the Joint Commissioner of
Police was to ensure that the matter be brought to the knowledge of higher
officers so that the cognizance of the observation made by the court may
be taken. However, it is really painful to note that despite said observation
made by the court the senior police officers have failed to take notice of
the same. Joint Commissioner of Police, New Delhi District has sent a
routine report asking four weeks time. There seems to be no justification
for asking four weeks time to file the report of such nature, more so when
time of 15 days has already been granted.
In the present facts and circumstances the copy of the
order of even date and of order dated 12.04.2022 be sent to the
Commissioner of Police, Delhi Police to ensure filing of status report
by the Joint Commissioner, New Delhi District on or before next date.
Be put up on 12.05.2022.
