Ld. counsel for the plaintiff requests for some time to
take fresh steps for service of summons in terms of order dated
08.06.2026.
Let fresh summons of suit be issued to the defendant
through all modes including e-mail, on filing of PF/RC, speed post
and approved courier for 05.02.2027. Steps be taken within two
weeks.
Ld. Counsel for the plaintiff is directed to file an
affidavit affirming the e-mail address of the defendant under Rule
12 of Delhi Courts Services of process by courier and electronic
mail service (Civil Proceedings) Rule, 2010.
In terms of Rule 13, plaintiff is further directed to
place on record a copy of the plaint and documents in electronic
form/scanned images in compliance of Rule 13 for
forwarding/annexing/attaching the same with the process. A
requisite process fee for sending process by e-mail in compliance of
Rule 14 be filed alongwith copies as above for onward transmission
to Nazarat Branch, Patiala House Courts for service through e-mail.

The summons to defendant shall indicate that a
written statement alongwith affidavit of admission/denial of
documents and statement of truth shall be positively filed within
stipulated period from the date of receipt of summons.
Ld. counsel for plaintiff is also directed to file
affidavit of service on the next date of hearing.
