569/RG/DHC/2021 dated 19.08.2021.

There is a request for adjournment on behalf of
applicant/accused.
On the last date, it was informed to the court that only short
issue remained between the parties.
Counsel for the complainant has objected to the adjourn
ment and stated that accused is trying to flee from the country and there
fore, adjournment be not granted.
Proxy counsel for applicant/accused has requested for pass
over for seeking instructions from the main counsel

Proxy counsel Sh. Chetanya Puri has stated that he is un
able to connect to the main counsel in the present case and he does not
have any contact details of the accused. The accused has not joined the
court proceedings through VC. He is not physically present in the court.
Therefore, let his appearance be awaited for 01.00 PM.
In the meanwhile, Ld. Proxy counsel for applicant/accused
to convey the directions to the main counsel.
It has been informed that the main counsel is not keeping
well. However, in case, counsel is unwell, client can appear in the court
and counsel is free to join the court through VC as instructions/statement
is required, whether the accused is in the process of leaving the country
or not, as this fact was not informed to the court on the last date of hear
ing.

Counsel for applicant/accused has joined through VC. He

has stated that settlement has not been arrived at so far. He has stated
that his client has no intention of leaving the country without the permis
sion of the court.
It has been informed that the main IO is not available today
in the present matter as there has been a death in the family of the IO.
Assistance of IO is required in the present case. Therefor, let there be no
arrest till the next date of hearing.
