the Plaintiff (through VC).
Heard. Perused.
Perusal of the record shows that, in the title or
heading of the suit, it is not mentioned that the present suit is
filed under Order XXXVII CPC, although, it is mentioned so in
the body of the suit and it is also mentioned in the plaint that the
last payment was made by the defendant to the plaintiff on
06.12.2023 but the statement of account filed by the plaintiff
does not reflect the same and further the original documents
where upon the present case has been filed under Order XXXVII
CPC, have neither been filed nor produced for inspection of the
Court.
Ld. proxy Counsel for the plaintiff undertakes to
inform the main counsel in this regard to do the needful.
Re-notify for consideration on 18.09.2026.
