Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: BAIL APPLICATION NO. 1218/2025
STATE OF DELHI VS. OM PRAKASH SANWARIA
FIR NO. 39/2022
PS: CYBER NEW DELHI
U/S. 420 IPC
31.07.2025
This is an application for regular bail filed on behalf of
applicant / accused Om Prakash Sanwaria.
Present: Sh. Ravindra Kumar, Ld. Addl. PP for the State.
Sh. A.H. Pasha, Ld. Defence Counsel for applicant.
IO SI Chandra Shekhar in person.
Complainant is present through VC.
Sh. Shubham Bhatia (counsel for complainant in
FIR No. 337/2018 PS EOW).
It is submitted by the ld. Defence Counsel that applicant has
been falsely implicated in the present case. He is in custody since
14.05.2025. It is submitted that the matter has been amicably settled
between the parties vide settlement deed dated 21.07.2025.
I have perused the said settlement deed. The said deed has been
purportedly signed by the applicant while he was in judicial custody.
The same is not attested by the Jail Superintendent. The complainant
who is present through VC has submitted that he received the copy of
the settlement through email and he sent the same after signing. It is

submitted that the same was not signed in his presence by the
accused.
The Ld. CJM in the order dated 23.07.2025 has rightly noted
that the main ground for seeking bail is the settlement between the
parties, the agreement shown, however, remains unauthenticated.
In the present case as per the report of the IO, the complainant
has been cheated for the amount of Rs. 22 lacs. As per report of the
IO, the applicant is involved in 10 such other matters. All the other
matters which are pending against the applicant are under S.
420/406/120B IPC & other offences. It seems that it is the modus
operandi of the applicant to lure innocent people and commit the
offence of cheating.
Considering the serious nature of allegations and the fact
that the applicant is a habitual offender, no ground is made out
for releasing the applicant / accused Om Prakash Sanwaria on
bail. The application is dismissed. Copy of the order be given
dasti.
