Fresh suit is received by way of random allocation. It be checked and
registered as per rules.
Present: Sh. Neeraj Kumar AND Sh. Suraj Parcha, Ld.
Counsel for the Plaintiff along with AR of the
plaintiff (through VC).
Issue summons of the suit as well as accompanying
applications, if any, to the defendant ‘subject to filing of fresh
statement of truth’ through all permissible mode including RC/Speed
Post/e-mail/Whatsapp on filing of PF along with plaint and with entire
paper book by the plaintiff for the next date of hearing. For service
through electronic mode, plaintiff to file affidavit of correctness of
mobile phone number and e-mail ID. Steps be taken within one week
from the date of this order.
Plaintiff is directed to file soft copy of entire paper book
including the plaint in PDF format for the purpose of e-mode service
to the defendant along with PF. Process be given dasti also, if so,
requested. The plaintiff is also directed to file the affidavit of service
on record.
Summons shall indicate that written statement has to be
filed by the defendant within 30 days from the date of service of the
summons as per the Proviso of Sub Rule 1 of Order 5 Rule 1 CPC as
applicable to the Commercial Courts Act. Accordingly, defendant
shall also file affidavit/statement of admission/denial of documents
along with WS as per Order XI CPC with advance copy to the
plaintiff. Thereafter, plaintiff is at liberty to file replication, if any,
with advance copy to the defendant.
Be put up on 22.09.2026 for appearance/report and
further proceedings.
