defendant.
Heard. Perused.
As per report of the Ahlmad, no report on the
summons issued to the defendant through ordinary course have
been received back and whatsapp summons shows single tick
whereas the summons were served on the given email ID of the
defendant on 24.08.2026. Ld. Counsel for the Plaintiff has placed
on record the affidavit of service along with the receipt and track
report qua the service of the defendant with the summons of the
suit issued through speed post and emails.
Ld. Associate Counsel for the plaintiff has submitted
that as per the track report, the defendant was also served with
the summons of the suit on 25.06.2026.
Ld. Counsels for the defendants have submitted that
the WS along with application under Order VIII Rule 1 for
condonation of delay in filing the WS shall be filed at the earliest
and advance copies thereof shall be supplied to the Ld. counsel
for the plaintiff.
Plaintiff may file replication ( subject to WS being

taken on record) and reply to the application (subject to
application coming on record) before the next date of hearing
with an advance copies thereof be supplied to the Ld. counsel for
the Plaintiff.
Re-notify for arguments on the aforesaid application
(subject to the application coming on record), admission/denial
of documents, framing of issues and case management hearing
on 15.12.2026.
