Today case is fixed for
ex parte PE.
Amended Memo of Parties not filed by plaintiff in
terms of last order.
At the outset, Ld. Counsel appearing on behalf of
plaintiff states at Bar that entire disputes involved in the present
matter have been settled between the parties by way of out of Court
Settlement and in terms of settlement, the plaintiff bank has received
entire settled amount from the defendants and thus, loan account of
the defendants has been closed. In view thereof, it is prayed that
present suit may be disposed off as compromised/ settled.
Separate statement of counsel of plaintiff is recorded in
this regard.
This is a suit for recovery of Rs.3,56,485.21
Paise filed
by plaintiff banks against the defendants.
Having considered the submissions made on behalf of
plaintiff and keeping in view statement made by counsel of plaintiff
and overall facts and circumstances of the case, the present suit is
disposed off as compromised/settled.
