At this stage, Ld. Counsel for defendants submits
that defendants not received the complete copy of plaint and
documents. Perusal of the undelivered/refused envelope of speed
post reflects that it contained the copy of plaint and documents
and on this eventuality, in case the defendant not received the
plaint and documents, it cannot termed as fault of plaintiff
because the plaintiff has taken appropriate steps for effecting
service of the defendants.
Under these eventuality, the request for supply of
copy of plaint and documents, it does not inspire the confidence
of the Court however, the copies attached with unserved/refused
envelope supplied.

It is specifically made clear that the written
statement is to be filed by defendant within the stipulated period
from 17.11.2025.
IA no. 2/25 U/s XVA r/w Section 151 CPC of plaintiff.
Ld. Counsel of defendants submits that copy of
aforesaid IA not supplied to defendants. Plaintiff is directed to
supply the same to the defendants.
Let reply to the aforesaid IA be filed by defendant
by next date of hearing with advance copy to opposite side.
List this IA on NDOH for arguments.
