Plaintiff has moved an application under Order XI
Rule 1 (4) CPC.
Plaintiff by way of this application seeks to place on
record copy of lease deed of property in question as
inadvertently, copy of lease deed of other property which is the
subject matter of the another suit CS (COMM.) 518/2025 has
been filed in the present case.
The counsel of plaintiff has also filed the copy of
lease deed. In view of the above submissions, the application is
allowed and copy of lease deed of the property in question of the
present suit is taken on record.
During perusal of the record it is revealed that
plaintiff has filed the site plant of the other property which is
subject matter of suit bearing CS (COMM) no. 518/2025.
Counsel of plaintiff seeks permission to place on record the site
plan of the property in question. Permission is granted.
Issue summons of the suit to the defendant by all
permissible modes including
e-mode on taking requisite steps by
the plaintiff returnable for next date of hearing.
Steps be taken within two weeks from the date of

this order.
Plaintiff is directed to file soft copy of entire paper
book in PDF format for the purpose of e-mode service to
defendant alongwith PF. Process be given dasti also, if so
requested.
The plaintiff is also directed to file the affidavit of
service on record.
Summons shall indicated that written statement has
to be filed by the defendant within 30 days (extendable upto 120
days with the leave of the court and that too subject to
appropriate terms) from the date of service of the process as per
the Proviso of Sub Rule 1 of Order 5 Rule 1 CPC as applicable to
the Commercial Courts Act.
Put up on 15.12.2025 for appearance of defendant
and for further proceedings.
