This is second application under section 483 BNSS for grant of
regular bail moved on behalf of accused/applicant Ajay Kumar
Paswan.

Part arguments on application are heard.
During the arguments, it is submitted by ld. Counsel for
accused/applicant that co-accused Ishwar Chand has been arrested
in another FIR by police of PS Bulandshahar, however, the fact, co-
accused Ishwar Chand has not been arrested in this case.
Upon specific query put by the court, IO submits that
he was on leave and accused Ishwar Chand is yet to be arrested in
this case.
Submissions heard. Record perused.
The present FIR was registered way back in December
2025 and IO is not sure about the status of co-accused Ishwar
Chand. It is submitted that till date he has not filed any application
for issuance of NBW against co-accused Ishwar Chand. Although,
he conducted the raid twice at the residence of co-accused Ishwar

Chand. It is astonishing to observed that co-accused Ishwar Chand,
who is equally involved in the commission of offence, has not been
traced out in view of the fact that he was arrested in another FIR in
Bulandshahar. It is surprising to observe that how come IO, who
was coordinating with the police officials of PS Cyber Cell,
Bulandshahar qua the present FIR, was not aware about the status of
co-accused Ishwar Chand. Hence, before hearing further arguments
on the present bail application, let a report be filed under the
signature of worthy DCP on next date of hearing qua the status of
co-accused Ishwar Chand.
Put up for further arguments on 27.07.2026.
Copy of this order be sent to office of worthy DCP for
intimation and compliance.
