Presence: Appellant in person with Ld. Counsel Sh. Asim
Naeem.
The present appeal has been filed against judgment dated
14.05.2025, passed by the court of Ld. JMFC (NI Act), Digital
Court-03, Patiala House Courts, New Delhi, convicting the appellant
for the offence punishable u/s 138 NI Act, and vide order on sentence
dated 29.05.2025, the convict/ appellant Ajay Sharma is sentenced to
undergo simple imprisonment for for a period of 02 months. Further,
appellant is directed to pay a fine of Rs.13,30,000/- to the complainant
as compensation. In default of payment, the convict/ appellant shall
undergo further simple imprisonment for 02 months.
Along with appeal, an application u/s 430(1) of BNSS is
filed for seeking suspension of the sentence. The sentence imposed
upon convict/ appellant Ajay Sharma is suspended till conclusion of
the present appeal, subject to furnishing bail bond in sum of
Rs.30,000/- with one surety in the like amount. Bail bonds have been
furnished. The same are accepted.
With respect to depositing of 20% of the compensation
amount, Ld. Counsel seeks time to argue the same. Till then, notice be
issued to the opposite party on filing of PF/ RC. Process be filed
within a week.
