Bail Matter No. 1012/2026
Mandeep Singh Vs. State
FIR No. 32/2026
P. S: Cyber South West, New Delhi
U/s : 318(4)319 BNS
During investigation, it was revealed that an amount of
approximately Rs. 70,000/- was transferred to Zomato Wallet. The details
of the said wallet were obtained which was found registered with Mobile
No.9546631005. The CDR analysis of said mobile number was condcuted
which was found operational in two mobile phones i.e. One Plus Mobile
Phone and Motorola Mobile Phone. On the basis of technical analysis and
electronic evidence, the user of said mobile number and mobile phones was
identified as the applicant. The applicant disclosed that he had come into
contact with one Telegram user, namely, 'Mr. X Pro' who told him to create
fraudulent phishing websites and links for cheating innocent persons in lieu
of monetary benefits. The aforesaid SIM number 9546631005 already
linked with the above said Zomato Wallet containing cheated money was
provided to the applicant by 'Mr. X Pro' in lieu of commission for his illegal
activities.
IO has submitted that during investigation, applicant revealed
that he has already formatted both the mobile phones, however, the said
mobile phones have been sent for data retrieval and forensic examination.
He, however, stated that applicant is in custody in this case since
14.04.2026 and he is not required for further investigation.
Ld. Counsel for the applicant has submitted that applicant has
been falsely implicated in the present case, he has clean antecedents and

without prejudice to his rights and defence, he has already paid the total
cheated amount of Rs. 1,00,427/- to the complainant/victim through
demand draft.
Without commenting upon the merits of the case, it is an
admitted position that the complainant/victim has already received cheated
amount of Rs.1,00,427/- from applicant/accused. The applicant is in
custody in this case since 14.04.2026 i.e. he has already suffered a custody
of about 24 days in this case and it seems that he is not required for any
further investigation. The prosecution has also not raised any serious
apprehension that if applicant is admitted to bail then he is a flight risk or
he may tamper with the evidence. It has also been stated that the applicant
has clean antecedents. In view of the above said discussion, period of
custody, no objection to bail given by the complainant/victim and without
commencing upon the merits of the case, no fruitful purpose would be
served by keeping the above said applicant in further custody. The
applicant/accused, Mandeep Singh is thus admitted to bail on furnishing a
personal bond in the sum of Rs.40,000/- with one surety of the like amount
subject to the satisfaction of Ld. CJM/Ld.Trial Court/Ld.Duty JMFC
subject to the following conditions:
a) The applicant/accused shall cooperate in the investigation and shall
join the investigation as and when required by IO / SHO concerned.
b) The applicant/accused shall not commit any similar offence or any
offence while on bail.
