Fresh petition u/s. 27 of Arbitration & Conciliation
Act, 1996, has been received by way of assignment. It be
checked and registered as per rules.
Present: Sh. Gaurav Kumar, ld. counsel for petitioner.
Sh. Amit Bhatnagar (appearing through V/C), ld.
counsel for respondent.
Ld. counsel for respondent has appeared on the basis
of advance notice. Heard and perused.
This petition has been filed seeking summoning of
one witness as mentioned in paragraph-6 of the petition. I have
perused the order dated 25.04.2026 as passed by ld. Arbitrator in
the arbitration proceedings, wherein he had allowed summoning
for this witness. Ld. counsel for respondent does not have any
objection. In view of the same, application/petition is allowed.
Issue summons to the witness as mentioned in
paragraph-6 of the petition, with direction to appear along with
complete summoned record before ld. Arbitrator in DIAC. The
particulars of arbitration number shall be furnished in PF and
summons be issued accordingly thereby mentioning the
particulars of arbitration proceedings wherein the witness has to
appear. Summon be given dasti to the AR of petitioner.
File be consigned to record room after due
compliance.
