In the present matter, an application under Section 151 CPC was filed by the defendant. It is stated in the present application that plaintiff seeks to place on record certain documents, which cannot be taken on record. On the other hand, Ld. Counsel for plaintiff states that he does not wish to prove the said documents by way of evidence nor he is relying upon the same. Considering the averments made by Ld. Counsel for plaintiff, since the plaintiff is not relying upon the said documents, which were objected to by Ld. Counsel for defendant by way of present application, the application u/s 151 CPC stands disposed off accordingly. Another application under Order I Rule 10 CPC filed on behalf of the defendant no. 2 seeking to be deleted from the array of parties. Same was listed for today, however further arguments heard. Ld. Counsel for defendant states that he will be filing certain judgments in support of his contentions.
