Fresh criminal appeal received by way of allocation. It be checked and registered as
per rules.
Present: Sh. Jai Ram Garg and Sh. Ritesh Goyal, Ld. Counsels for the
appellant.
Present appeal is filed against the judgment dated 13.01.2026 and order
on sentence dated 13.02.2026 whereby the appellant has been convicted U/s. 138 N.I.
Act. As per order on sentence dated 13.02.2026, the appellant has been sentenced to
pay fine/compensation for an amount of Rs. 47,19,451/- to the complainant along with
simple interest of 9% per annum from the date of filing of criminal complaint and in
default Simple Imprisonment for a period of six months.
Application for suspension of sentence is also filed along with the
present appeal. Submissions heard on suspension of sentence.
It is further stated that the convict failed to file appeal in time and as
such is presently in custody, serving the sentence imposed.
Subject to furnishing the personal bond in the sum of Rs. 15,000/- with
one surety of the like amount before the Ld. Trial Court/Ld. Duty MM, the order on
sentence is suspended till disposal of the appeal. Release warrants may be issued by
the Ld. Trial Court only after bail bonds are furnished.
Issue notice of the application for condonation of delay with appeal to
the respondent on filing of PF/RC (to be filed in one week) for the next date of
hearing. Order u/s 148 NI Act would be passed on the next date of hearing after hearing
the opposite party.
Be put up on 27.05.2026.
TCR be summoned for the next date of hearing.
